Family law: divorce, custody, online divorce and prenups

TapTapSearch Editors · 2026-10-28

Family law matters are personal and the rules vary by state, so the right kind of help depends on how much you and the other person agree on.

Uncontested vs contested divorce

In an uncontested divorce both spouses agree on property, debts, support and custody. It is faster and cheaper. A contested divorce, where you disagree, usually needs lawyers on both sides.

Online divorce services

These prepare the court forms for uncontested divorces at a low fixed price. They do not give legal advice, so they suit simple cases without significant assets or custody disputes.

Child custody

Courts decide custody based on the best interests of the child. Mediation is often required or encouraged before a court hearing.

Prenuptial agreements

A prenup sets out how property and debts are handled if the marriage ends. For it to hold up, both people generally need full financial disclosure and time to review it, ideally each with their own lawyer.

Choosing a lawyer

Ask about hourly rates, retainers, experience in your county’s courts, and whether they support mediation.
